Dealing With Death At the Chubb Law firm, we understand the unique set of challenges you and your family face after the death of a loved one.
We further realize that dealing with the California probate court or working through trust administration can be stressful, time consuming and costly. That is why our Sacramento will and trust attorneys offer a full-service approach to probate or trust administration designed to minimize headaches, quickly transfer assets and ensure all legal requirements are satisfied within the appropriate deadlines. All of this is done with love and compassion during a difficult time. We further assist in the process of trust administration to ensure your family has all of the information, guidance and resources they need when you are no longer here to provide for them. We’ve found though the years that many people do not understand their roles and responsibilities in administering a trust, and that is why we work closely with the family to ensure there is nothing missed on their part. Specifically, upon the death of a loved one, we prepare a comprehensive trust administration memorandum that prepares the successor trustee for their duties as the trustee of the trust. We stand ready to assist the family in every way to resolve property transfers and other loose ends that exist after death. Fortunately, estate settlement involving a revocable living trust is generally easier than going through the probate process--in part, because it’s faster. Also, the successor trustee can access accounts immediately, which is certainly more convenient than waiting for authorization from the probate court. But again, complications can arise at settlement if the trust s not “fully funded.” This means all of the assets have not been transferred to the trust in question. Again, we work closely the withfamily if this happens to ensure they receive what’s rightfully theirs in a fast and smooth manner. Finally, our Sacramento estate planning lawyers take great pride in our ability to bring families together in a time when even the closest families fall apart. Our commitment is to you, our client, and we do everything in our power to ensure your family experiences security, ease and support following the death of a loved one. |
